All law enforcement agencies in the country will be responsible for provision of security, law enforcement and now, thanks to to amendments in the Traffic Act, enforce Traffic Regulations. Insertions Section 117A and 117B into Cap. 403 in the newly enacted Traffic Amendment Act 2012 have given mandate to the whole Police Service to enforce all laws, including traffic rules.
Section 117A states that the Inspector-General of the Police shall prepare a document showing the offenses set out in the Traffic Act and their respective penalties, in a summary form, and the document shall be made available to ALL law enforcement officers for purposes of enforcing the Act.
Section 117B goes ahead to clarify that "for the avoidance of doubt, the administrative unit of the Kenya Police Service known as the Traffic Department is hereby abolished."
This essentially means that regular police and the Administration Police will be responsible for enforcing the new laws as opposed to the designated Traffic Police that have been responsible for the same. The new laws come with heavy penalties designed to bring sanity on Kenyan roads which according to statistics, 2,774 people have died through road accidents in Kenya since January 2012.
